Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

According to prosecution case, the petitioner along with his family members murdered the daughter of the informant by strangulating her by pressing her neck with an iron rod and also by pressing her mouth with a pillow. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been

Patna High Court CR. MISC. No.58871 of 2022(6) dt.15-03-2023 2/2 implicated in the present case. He further submits that the petitioner is the husband of the deceased. The petitioner is in custody since 07.04.2022.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that during investigation it has come that the petitioner has committed murder of his wife and the postmortem report also corroborated the allegation as alleged in the F.I.R. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Paroo P.S. Case No. 60 of 2022 pending in the court of learned Additional Chief Judicial Magistrate III Court, Muzaffarpur. Prayer is refused.
