JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 The petitioner seeks regular bail in connection with Kurhani P.S. Case No. 544 of 2018, registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is that he set his wife on fire causing burn injuries to her and later on he succumbed to her injuries.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and now the matter has also been compromised between the parties and he has been judicial custody since 28.11.2018 and charge has already been framed in this case.

Learned counsel for the State opposed the prayer for bail on the ground that there is allegation against the petitioner

Patna High Court CR. MISC. No.51586 of 2019(5) dt.16-11-2019 2/2 of causing death of his wife by setting her on fire. Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the informant and his family members are examined, petitioner will be at liberty to renew his prayer for bail in the Trial Court itself, which will be considered by the Trial Court on the basis of materials available at that time.
