JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-08-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application in respect of petitioner no.2, Arun Turi.

Permission is granted.

Accordingly, this anticipatory bail application is dismissed as withdrawn so far as petitioner no.2, Arun Turi is concerned.

Learned counsel for the petitioners seeks permission to correct the name of the police station mentioned in the cause title of this anticipatory bail application.

Permission is granted and the learned counsel for the petitioners is directed to correct the name of police station

Heard learned counsel for the petitioners and learned APP for the State.

Petitioners No.1 and 3 apprehend their arrest in connection with Laxamipur P.S. Case No.234 of 2021, registered for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 354(A), 380, 449, 504 and 506 of the Indian Penal Code.

The petitioners and other co-accused persons are said to have assaulted the informant by means of rod on his head. The informant became unconscious and fell down on the ground. It is alleged that the accused persons entered into the house of the informant and took away cash of Rs.30,000/- and ornaments kept in a box. It is also alleged that the accused persons assaulted his wife and snatched nose pin and chain from possession of wife of the informant.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is case and counter case between the parties

Learned APP for the State opposed the prayer for anticipatory bail of the petitioenrs.

Taking into consideration the facts that there is case and counter case between the parties, both sides sustained injuries and the injuries are simple in nature, let petitioners no.1 and 3, namely, Krishna Turi and Sunil Turi, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Laxamipur P.S. Case No.234 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
