The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 447, 448, 504, 506, 307 of the Indian Penal Code and sections 27 of the Arms Act.

As per allegation in the FIR, while the informant was at her house, five accused persons entered into her house and pressurizing her to withdraw a case which was filed by her earlier. On denial, co-accused Dhuldhul Kumar and Gopal Singh caught hold of the informant and on the order of Chanda Kumar and petitioner, Arjun Singh fired upon the informant. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Specific

Patna High Court CR. MISC. No. 54592 of 2022(2) dt.18-01-2023 2/2 allegation of firing is against co-accused Arjun Singh. No specific overt act is attributed against the petitioner. Similarly situated other co-accused Dhuldhul Kuamr had already been granted regular bail vide order dated 24.12.2022 passed in Cr. Misc. No. 55525 of 2022. Petitioner is languishing in judicial custody since 22.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge XVII, Bhojpur at Ara in connection with Sandesh P.S.
