2. The petitioner seeks bail in connection with Sikarpur P.S. Case No. 622 of 2023 registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code.

3. This is the second attempt by the petitioner for the prayer of regular bail. Earlier, this Court vide order dated 31.01.2024 in Cr. Misc. No. 3260 of 2024 had dismissed the regular bail of the petitioner.

4. Learned counsel for the petitioner submits that the trial has started and out of eleven chargesheet witnesses, five witnesses have been examined. It has been further submitted that the witnesses are not coming in the trial and on the last two dates, no witness has turned up. The petitioner is in jail since 04.08.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.58164 of 2024(3) dt.29-11-2024 2/2 prayer for regular bail of the petitioner.

6. Considering the fact that the petitioner is in jail since 04.08.2023 and the trial has started as also the fact that the petitioner is co-operating in trial, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Sikarpur P.S. Case No. 622 of 2023, subject to the following conditions:

(i) One of the bailors shall be a close relative of the petitioner (ii) The petitioner will mark his attendance at Sikarpur Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

(iii) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court.
