JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, petitioner is named in the first information report and he could be arrested in the present case after 9 years of the alleged occurrence but submission on behalf of the petitioner is that having identical case, the co-accused Ravindra Paswan and Ravi Pandey were granted bail prior to arrest of the petitioner whereas two other co-accused, namely, Baijnath and Anjani Singh, having more or less similar allegation, were granted privilege of bail by a co-ordinate Bench of this Court vide order dated 31.01.2016 passed in Cr. Misc. No. 27144 of 2016 after arrest of the petitioner in the present case. Considering the aforesaid facts and circumstances as

No.6545 of 2017 (2) dt.01-03-2017 2/2 well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Sessiosn Judge, Aurangabad in connection with Session trial no. 317D/09/23/16 (Pauthu P.S.Case No. 31 of 2007).
