JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Jalalpur P.S.Case No. 165 of 2017 registered under Sections 341, 323, 324 and 379/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that though there is allegation that the petitioner had assaulted the informant with sharp edged weapon but the injury report would suggest that the injuries caused were all simple and superficial in nature. It is further submitted that two other coaccused, namely, Aishwarya Ashish and Vinay Kumar Gupta having more or less similar allegation have already been granted pre-arrest bail by the court below itself vide order dated

Patna High Court Cr.Misc. No.18336 of 2018 (2) dt.05-04-2018 2/2 24.11.2017 passed in A.B.P. No. 2905 of 2017, as contained in Annexure-3 to the present application.

Considering the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- IX, Saran, Chapra in connection with Jalalpur P.S.Case No. 165 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
