The petitioner seeks bail in connection with Bakhtiarpur P.S Case No. 251 of 2016 registered for the offence punishable under Section 273/34 of the Indian Penal Code and Section 30(A) of the Excise Act.
Allegedly, acting on a tip of that the petitioner and Harendra Yadav have gone with liquor, raid was conducted and at the tea shop of Harendra Yadav petitioner was standing and beneath the counter in plastic bag, there was illicit liquor. The petitioner was apprehended and after search 18 bottles of Royal Stage Whiskey each containing 750 M.L. was recovered and from possession of the petitioner Nokia Mobile and cash of Rs. 7,500/-
Patna High Court Cr.Misc. No.5204 of 2017 (2) dt.10-03-2017 2/2 were seized.
Submission is of false implication and that the petitioner is suffering in custody since 18.10.2016 having clean antecedent.
The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Barh District Patna, in connection with Bakhtiyarpur P.S. Case No. 251 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
