2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 504, 379 of the Indian Penal Code.

3. As per prosecution case, the petitioner along with other accused persons are alleged to have assaulted the informant and his family members due to which they sustained injury. The alleged occurrence took place in the background of land dispute.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is land dispute between he parties due to which the petitioner has

It is also submitted that the injured sustained by injured persons are simple in nature. Moreover, similarly situated co-accused namely, Sonu Kumar has already been granted bail by a co-ordinate Bench of this Court vide order dt. 25.7.2023 passed in Cr. Misc. No. 44087 of 2023. It is further submitted that the petitioner is languishing in judicial custody since 21.5.2023.

5. Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Singhia P.S. Case No. 119 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C. Rosera, Samastipur.
