JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 01.03.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is in jail custody since 21.9.2015 and while rejecting bail prayer of the petitioner this court, vide order dated 17.8.2016 passed in Cr. Misc. no. 26942/2016, directed the trial court to conclude the trial of the petitioner within four months from the date of receipt/production of a copy of the aforesaid order. Liberty was also given to the petitioner to renew his prayer for bail, if his trial is not concluded within the above stated period.

The impugned order of learned Addl. Sessions Judge II, Siwan goes to show that charge against the petitioner was framed on 10.5.2016 and even after issuance of processes to prosecution witnesses up till now, only one prosecution witness could be examined.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that

Patna High Court Cr.Misc. No.5207 of 2017 (2) dt.01-03-2017 petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II, Siwan in Sessions trial no. 186/2016 arising out of Siwan Mufassil P.S. Case no. 246/2015.
