JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-08-2019 This is an application for grant of anticipatory bail in connection with Abadpur P.S. Case No. 61 of 2019, disclosing offences under Sections 379, 414, 34 of IPC. Prosecution case is that a theft was committed in Uttam Bihar Gramin Mini Bank, due to which several articles including the cash of Rs.5000/- were missing. It has further been alleged that the villagers arrived there and on the basis of shoes, they identified the co-accused Jabir, who disclosed the names of other accused persons, during the investigation. Submission of the learned counsel for the petitioner is that he has not named in the F.I.R. and nothing has been recovered from his possession. Further submission is that he has no criminal antecedent.

No.53267 of 2019(2) dt.26-08-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a direction to the learned court below to verify the antecedent of the petitioner and during the verification, the petitioner will be released on provisional bail, and if found no criminal antecedent against him, he will be released on bail on its own satisfaction, otherwise, the petitioner shall surrender and make prayer for regular bail.
