2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act 2022 .

3 . As per prosecution case , 26.400 litres illicit liquor was recovered from an orchard.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case . The name of this petitioner transpired during course of investigation . No incriminating material has been recovered from conscious possession of this petitioner and he has got no concern with the alleged recovery . The orchard in question does not belong to this petitioner. Recovery has been made from an open place

5 . Learned A.P.P. for the State vehemently opposed the bail application .

Considering the nature of accusation, place of recovery and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Exclusive special Excise Court Madhubani in connection with Bisfi P. S. Case No. 96 of 2025 , subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 .
