2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 304B and 120B of the Indian Penal Code.

3. It is a case of 'dowry death'.

4. Petitioner No. 1 is the brother-in-law, Petitioner No. 2 is the mother-in-law, Petitioner No. 3 is the sister-in-law and Petitioner No. 4 is the unmarried nanad of the deceased.

5. It is submitted by learned counsel for the petitioners that thrust of the allegation is against husband of the deceased, who is already in custody. Petitioners are separate in mess & property and have got no concern with the affairs of deceased

Patna High Court CR. MISC. No.56696 of 2023(3) dt.06-12-2023 2/2 and her husband. The allegation of torture and demand of dowry against these petitioners is general and omnibus. Similarly situated co-accused persons have been granted privilege of anticipatory bail vide order dated 03.08.2023 passed in Cr. Misc. No. 22046 of 2023. Petitioners claim clean antecedents.

6. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

7. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of the petitioners is allowed.

8. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, District- Madhbani, in connection with Benipatti P.S. Case No.211 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
