JUSTICE ARUN KUMAR ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.
The petitioner already in custody in connection with Ariari P.S. Case No.86 of 2016 is an accused in a case registered under Sections 302, 307 and 504/34 of the Indian Penal Code. Allegation in brief is that this petitioner along with two others assaulted the informant's father. Specific allegation against the petitioner is that he gave one iron rod blow over the head of the informant's father resulting into his death. It is submitted that due to partition dispute, all family members have been implicated including the petitioner and this petitioner has got no criminal antecedent and has been in custody since 13.12.2016.

No.5595 of 2017 (3) dt.09-03-2017 2 / 2 rod blow over the head of the deceased and it appears that the deceased had sustained three corresponding injuries over the head, so the prayer for bail on behalf of the petitioner is rejected in connection with Ariari P.S. Case No.86 of 2016, pending before the learned S.D.J.M., Sheikhpura.
The trial court is directed to expedite the trial after submission of charge sheet and preferably conclude the same within a period of one year.
