The petitioners apprehend their arrest in Bihta P.S. Case No. 524 of 2017 instituted for the offence under Sections 302 and 201 of the Indian Penal Code.
It is alleged in the written report that petitioners committed torture with daughter of the informant for not giving them an amount of Rs.1,00,000/- which was deposited by the informant in the Bank as Fixed Deposit in the name of her daughter. It is alleged that on 30.07.2017, petitioners have committed murder of daughter of the informant and have got the dead body disappeared. The informant got information from the
Patna High Court Cr.Misc. No.12109 of 2018 (3) dt.09-04-2018 2/2 villagers on his Mobile and went to Sasural of his daughter. He did not find his daughter in her Sasural and the accused persons did not give any information about her.
Case diary has been received.
Learned A.P.P. has submitted that dead body has been recovered from a river. Postmortem was performed on 1.8.2017 wherein the Doctor has found specific burn injury over the body. The Doctor has opined the cause of death was Asphyxia due to drowning and also extensive burn injury over the body of the deceased.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
