JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section394 of the Indian Penal Code. Petitioner is not named but it appears that name of the petitioner came in confessional statement of co-accused, Manish Kumar and after that, Rs. 3,000/- is said to have been recovered from beneath the bed of the petitioner. Contention on behalf of the petitioner is that except the aforesaid confessional statement and so-called recovery as well as criminal antecedent of the petitioner, there is nothing against him and the petitioner has not been put on test identification parade. Patna High Court Cr.Misc. No.11328 of 2016 (2) dt.14-03-2016 of Rs. 3000/- is concerned; the same is not a looted amount. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dighwara P.S.
