This application is for grant of bail in connection with Saraiya P.S.Case No.101 of 2001 for the offence under Section 392 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. and only on the basis of suspicion, he has been made accused in the present case and nothing has been recovered from the possession of the petitioner. He is in custody since 23.12.2016.

Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner stating that the petitioner has criminal antecedent.

Having heard both sides. Considering the fact that there is

No.5801 of 2017 (3) dt.23-02-2017 2/2 only suspicion coupled with the fact that he has criminal antecedent, as such I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after completion of six months of period in custody. With the aforesaid observation, this application is dismissed.
