Petitioner is languishing in jail since 22.12.2015 in connection with Khushrupur P.S. Case No. 138/15 for offences alleged under Sections 420, 467, 468, 471 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that co-accused Arman Singh and Ranjeet Kumar Sinha by impersonating the petitioner registered a fake document and in this way cheated the informant and his husband of Rs. 7,60,000/-.
It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated
Patna High Court Cr.Misc. No.15525 of 2016 (3) dt.24-05-2016 2/3 on the basis of a civil dispute in which the allegation is upon other co-accused Ranjeet Kumar Sinha and Arman Singh who had taken money for registration of land from the informant's husband. He submits that petitioner is not alleged to have taken a single penny and the impersonation of the petitioner on the registered sale deed is done by the other co-accused, who had taken money from the information's husband. It has further been submitted that the petitioner is charge-sheeted, is not concerned with the informant's family and there is no chance of tampering with the evidence or absconding.
However, learned APP for the State submits that the petitioner is named in the First Information Report and he along with co-accused had registered a fake document by impersonating the petitioner, hence, opposes the prayer for bail. Be that as it may, considering the period of custody, matter relates to civil dispute and that the petitioner is not alleged to have taken a single penny, let petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Roy, learned Judicial Magistrate, Patna City in connection with Khushrupur P.S. Case No.138/15. However, it is made clear that petitioner will appear
Patna High Court Cr.Misc. No.15525 of 2016 (3) dt.24-05-2016 3/3 before the police/ court as and when required and failure to appear on two consecutive dates will be liable for cancellation of his bail bonds.
