The petitioner seeks bail in a case instituted under Sections 392 and 395 of the Indian Penal Code. The prosecution story, in brief, is that some unknown miscreants after pointing out country made pistol towards the informant, snatched the brown colour bag from the hand of the colleague of the informant namely Ranjit Kumar, in which Rs. 4, 51, 000/- was kept.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.6822 of 2017 (2) dt.03-03-2017 2/2 witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come in the confessional statement of co-accused namely Raja Hussain. He has not been put on T.I.P. nor there is recovery of any incriminating article from the possession of the petitioner.
On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siwan Muffasil P.S.
