In this case, the petitioners are seeking anticipatory bail in connection with Masrakh P.S. Case No.38 of 2018, registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.

As per the statement of the victim recorded under Section 164 of the Cr.P.C. it shows that under the allurement she was asked to visit fair and later on, she was confined by the petitioners in a room and her hands, legs and mouth were tied and they were asking the account number of the Bank and about the ornaments lying in her house.

Patna High Court Cr.Misc. No.26600 of 2018(2) dt.03-05-2018 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within three weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
