JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Petitioner is languishing in custody since 23.04.2013 in a case registered for the offences punishable under Section 302/34 of the I.P.C.

The brother of the informant was killed when the F.I.R. was lodged against unknown. The name of the petitioner sprang up subsequently.

It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case and was not aware about his involvement in the present case.

Learned A.P.P. has not controverted this fact that only suspicion has been raised by the witnesses in their statements recorded during investigation.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.25431 of 2014 (5) dt.08-01-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Pirpainty P.S. Case No. 18 of 1992.

Since in a case of 1992 the petitioner has been arrested in 2013, learned Court below will positively cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during the trial. (Dinesh Kumar Singh, J) Shageer/- U T
