Petitioner apprehends his arrest in connection with Jehanabad P.S. Case No. 812 of 2017, registered for the offences punishable under Sections 341, 323, 324, 354 and 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is that in course of altercation with respect to fixing of meter they have assaulted the informant by knife, causing injury to him.
Submission of learned counsel for the petitioner is that injury is one day prior to the occurrence and that shows falsity of the case. Further submission is that there is general allegation of assault against many persons but only one injury was found.
Patna High Court Cr.Misc. No.27624 of 2018 (2) dt.11-05-2018 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail stating that injury was grievous. Having heard both sides and in view of the fact that there is no specific allegation against the petitioner, who is a Government servant, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 812 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned and further condition is that he has to co-operate in investigation otherwise his bail bond shall be cancelled.
