JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-05-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Turkaulia P.S. Case No.240 of 2017 registered under Sections 341, 323, 504, 506, 332, 333, 307 and 353 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that co-accused Shyam Bihari Mahto having identical allegation to that of the petitioners has already been granted pre-arrest bail by a Bench of this Court vide order dated 27.11.2017 passed in Cr. Misc. No.55290 of 2017.

Patna High Court Cr.Misc. No.26268 of 2018 (2) dt.03-05-2018 2/2 The submission made by the learned counsel for the petitioners has not been disputed by the learned counsel for the State.

In that view of the matter, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No.240 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
