23-05-2016 The petitioner apprehends his arrest in relation to Goraiya Kothi P.S. Case No. 13 of 2016 registered under Sections 147, 148, 149, 332, 337, 353, 307, 427, 225, 419, 420, 504, 272, 273 of the Indian Penal Code and 47A of the Excise Act and 3/4 of the Public Damage Property Act.
The allegation pertains to an occurrence of 12.02.2016, where upon a raid, from a wooden Gumti/Shop, certain amount of country liquor was recovered. The allegation being that country liquor was sold illegally. It is alleged that when the person was being caught and taken away by the police, a mob assembled there and ensured to escape the person from the custody of police. Petitioner is identified as one of
Patna High Court Cr.Misc. No.21938 of 2016 (2) dt.23-05-2016 2 / 2 the persons in the mob. Attention of this Court is drawn to order dated 09.05.2016 passed in Cr. Misc. No. 18914/2016 (Surendra Baitha Vs. State of Bihar) by which under similar circumstances, this Court has granted anticipatory bail to another similarly situated coaccused. Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Rakesh Kumar Mahto, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sri Manoj Kumar, Judicial Magistrate, 1st Class, Siwan, in connection with Goraiya Kothi P.S. Case No. 13 of 2016, subject to conditions laid down under Section 438
(2) of the Code of Criminal Procedure.
