The petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code read with Section 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 17.07.2021 and chargesheet has been submitted. Petitioner is a person with clean antecedent. Learned counsel for the petitioner submits that accused Hari Kishore and Parmeshwar Yadav from whom arms were recovered, and on whose confessional statement the name of the petitioner transpired, has been granted bail by order dated 12.08.2021 in Cr. Misc. No. 30126 of 2021 and by order dated

Patna High Court CR. MISC. No.64786 of 2021(2) dt.01-04-2022 2/2 27.08.2021 in Cr. Misc. No. 31849 of 2021. It is, thus, submitted that the accused on whose confessional statement the name of the petitioner transpired, they have been granted bail, as such, the petitioner also deserves to be enlarged on bail. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 17.07.2021, chargesheet has been submitted in the case, petitioner is a person with clean antecedent and co-accused, as aforesaid, has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Banka P.S. Case No. 38 of 2021.
