JUSTICE SHIVAJI PANDEY ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Amnaur P.S. Case No. 118 of 2013 registered for offences under sections 341/323/324/307/504 and 379 of the Indian Penal Code.

There is an allegation that there was a hot discussion between the parties and later on, the victim received deadly injury in his neck by stab.

The counsel for the petitioner submits that there is a case and counter case and has drawn attention of this Court to the order of the Sessions Judge where it has been mentioned in the case diary that no doubt there is no injury report but he was shown

Patna High Court Cr.Misc. No.31656 of 2014 (2) dt.21-01-2015 his admission in P.M.C.H., Patna where the victim was treated and the Doctor recorded the nature of injury which had been received by the victim.

Today also the counsel for the petitioner has produced the injury report of the PMCH where the victim was treated in the Unit of Doctor, Professor, J.P. Singh where the nature of injury has been recorded.

The counsel for the petitioner submits that it is a case and counter case from both sides and from his side the case was lodged earlier.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, this petition is rejected.
