JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-04-2018 Submission of learned counsel for the petitioners is that during the pendency of this application, petitioners no.1 and 2 have been arrested. As such, he seeks permission to withdraw their application.
Such permission is accorded.
Accordingly, the application of petitioners no. 1 and 2 is dismissed as withdrawn.
Heard learned counsel for the petitioner no. 3 and the learned A.P.P. for the State.
The petitioner no. 3 Umesh Kumar Mandal @ Umesh Mandal apprehends his arrest in connection with Laukahi P.S. Case No. 119 of 2017 registered under Sections
Patna High Court Cr.Misc. No.24710 of 2018(2) dt.30-04-2018 2/2 147, 149, 341, 323, 324, 307, 354, 379, 448, 380 and 504 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that there is case and counter case between the parties. In the alleged occurrence, both the parties have sustained injuries. Further submission is that petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner no. 3 Umesh Kumar Mandal @ Umesh Mandal, be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 119 of 2017 corresponding to G.R. no. 960 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
