In this case, the petitioner is seeking bail in connection with Goraul P.S. Case No. 56 of 2016 registered for offences under sections 124(A) of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act and Section 10, 13, 16, 17, 18, 20, 22 of the U.A.P. Act and Section 17 of the C.L.A. Act. The police, on receiving confidential information, went to the village Rasulpur Daud where 50 to 60 persons were assembled and were raising slogan Lal Salam Jindabad as also anti-social slogan. The police chased and certain persons were arrested and, on the statement of Ravindra Sahani, illegal arms were also recovered from the ditch.

Patna High Court Cr.Misc. No.24332 of 2016 (2) dt.01-06-2016 Learned counsel for the petitioner submits that the petitioner is a private teacher. The petitioner has got no criminal antecedent and is in custody since 14.3.2016. Looking to the facts and circumstances of the case, let the petitioner, namely, Naresh Ram, be released on bail in the 1st week of July, 2016 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No.

56 2016, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
