====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-09-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections Sections 147, 323, 341, 418, 419, 423, 424, 465, 467, 468, 471, 472, 474, 504, 506 and 120B of the Indian Penal Code.

Prayer for anticipatory bail of the petitioners and others was refused on 09.01.2019 in Cr. Misc. No. 63121 of 2018 for the reason that the petitioners had suppressed their criminal antecedent in para 3 of the bail petition. The petitioners

Patna High Court CR. MISC. No.56626 of 2019(2) dt.18-09-2019 2/2 did not comply the order of this Court to surrender within a period of ten days and pray for regular bail. Hence, this Court was inclined to dismiss this application with heavy cost for unnecessarily consuming the precious time of the Court.

However, learned counsel for the petitioners seeks permission to withdraw this application.

Accordingly, this application is dismissed as withdrawn in connection with Complaint Case No. 49 of 2017 pending in the Court of learned 3rd Additional Chief Judicial Magistrate, Madhepura.
