The present petition has been filed with a prayer to restore Cr. Misc. No. 49807 of 2016, which stood dismissed due to non- compliance of peremptory order dated 22.11.2016. By the said order learned counsel for the petitioner was granted a week time for removing defects. This order was peremptory order. After hearing learned counsel for the parties and considering the facts disclosed in the petition , same is allowed. Let Cr. Misc. No. 49807 of 2016 be restored to its original file.
It is clarified that if the order dated 22.11.2016 is not
