Petitioner is apprehending his arrest in connection with Sadar (Mufasil) P.S.Case No.112 of 2019 , registered for offences punishable under Sections 307, 399/402 of the Indian Penal Code Sections 25(1-b)a, 26/35/27 of the Arms Act. Prosecution story is that the police intercepted one vehicle and five persons were sitting in that, however, two persons were arrested and three persons succeeded in fleeing away and from the vehicle .315 bore cartridges and .25 mm were recovered from the vehicle and the arrested accused persons named this petitioner. Apart from that he is accused in one more case.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.51557 of 2019(2) dt.19-08-2019 2/2 that except the confessional statement there is nothing against him and the other cases is under Section 354 (B) of the IPC and 68 (B) of the I.T. Act.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Sadar (Mufasil) P.S.Case No.112 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that in future, if he is found involved in such type of cases, the prosecution is at liberty to move for cancellation of his bail bond.
