JUSTICE RAMESH KUMAR DATTA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The only grievance of the petitioner is that in view of the Government Notification dated 25.4.2007, the petitioner would be entitled to the higher pay scale of special category Driver of Rs. 5000-8000/- with respect to which he gave representation and for which the Accountant General, Bihar has also written to the Director General, Health Services, Bihar on 28.11.2007 since the said notification had been brought into force with effect from 8.11.1996 and the petitioner had retired admittedly on 30.9.1997.

Patna High Court CWJC No.15374 of 2011 (3) dt.14-01-2015 2/2 In the aforesaid circumstances, the writ application is disposed of with a direction to the respondent no.4, the Director General, Health Services, Bihar to consider and dispose of the claim of the petitioner within a period of three months from the date of receipt/production of a copy of this order and if any amount is found further due and payable to the petitioner, the benefits of the same should also be paid to the petitioner within a further period of three months thereafter.
