The petitioner apprehends his arrest in Minapur P.S. Case No. 306 of 2012, registered for the offences punishable under Sections 341, 323, 324, 307, 506 and 34 of the Indian Penal Code.

The informant alleged that the petitioner assaulted him by farsa causing injury on his head.

The FIR was lodged on 14.11.2012 but from perusal of the record it appears that the case was sent to the court after delay of seven days. The petitioner has also made statement. There is a counter case bearing Minapur P.S. Case No. 305/2012 filed by the petitioner against the informant and his daughter-in-law. Considering the facts aforesaid and the fact that there is case

Patna High Court Cr.Misc. No.30187 of 2016 (2) dt.09-09-2016 2/2 and counter case and the injury is simple in nature, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 306 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
