The petitioner prays for anticipatory bail in connection Makdumpur PS case no. 279 of 2016 registered for the offence punishable under sections 341, 323, 324, 307, 379/34 of Indian Penal Code.

It is submitted on behalf of petitioners that there is case and counter case pending between the parties, the allegations are general and omnibus in nature and no specific allegation has been alleged against the petitioners. It is further submitted that there is previous enmity between the parties and petitioners' side has also received injuries.

Patna High Court Cr.Misc. No.8833 of 2017 (2) dt.03-03-2017 2/2 Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Having heard both sides. In view of the fact that there is case and counter case pending between the parties, both sides have received injuries and the injuries are simple in nature except one injury on the head but that injury has not been specifically attributed against any of the petitioners, the bail application of petitioners is allowed and they are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Makdumpur P.S. case no. 279 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
