The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 448, 341, 323, 324, 325, 307, 354(B), 504 and 506 of the Indian Penal Code. The prosecution case in short is that the accused persons surrounded the informant and assaulted him due to which he sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.6.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner along with other co-accused persons namely Shaligram Das is alleged to have assaulted the informant. Only one injury is grievous in

Patna High Court CR. MISC. No.51384 of 2019(2) dt.19-08-2019 2/2 nature and another is simple. There is no specific assertion against the accused who has caused the grievous injury. Other co-accused has been granted bail vide Annexure-3 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Banka in connection with Jaipur P.S. Case No. 32/18, G.R. No. 2863 of 2018.
