Let the defect(s), if any, as pointed out by the office be removed within four weeks from today.

In the present case, the petitioner seeks bail in connection with Singheshwar P.S. Case No. 10 of 2021 registered for the alleged offences under Sections 8(c), 21(c), 22(c), 23, 24, 25, 27(A), 29 of the Narcotic Drugs and Psychotropic Substance Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner that he was supplying narcotic cough syrup in connivance with co-accused Vijay Mahto. 27 bottles of such cough syrup were recovered from the Tea Stall of the co-accused and the petitioner is said to have fled

The learned counsel for the petitioner submits that there is no involvement of the petitioner in the recovery made by the police. The petitioner has not been apprehended from the spot and he was named in the case due to high handedness of police. The petitioner has made accused in a number of cases and he is on bail in all such cases. Further co-accused Bijay Mahto, from whom recovery was made, has been granted bail by the Coordinate Bench vide order dated 06.01.2022 passed in Criminal Misc. No. 41768 of 2021. Learned counsel further submits that charge has been framed in the case and the petitioner is in custody since 19.04.2021.

Learned A.P.P. for the State has opposed the submissions made on behalf of the petitioner. Learned A.P.P. submits that the petitioner is having long criminal history and co-accused has also named for his involvement. Having regard to the submissions made hereinabove and considering the fact that the co-accused from whom the recovery was made has been allowed bail and further considering the period of custody of the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of

Case No. 10 of 2021, subject to the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every day fixed by the court below.

(iii) In case of absence for three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned. (Arun Kumar Jha, J) ved/- U T
