The petitioner apprehends his arrest in Kahalgaon P.S. Case No. 299 of 2013 registered for the offences punishable under Sections 147, 149, 341, 323, 324 and 307 of the Indian Penal Code.
Allegation against the petitioner is that the petitioner and others assaulted the informant with knife and other weapons. It is submitted that the petitioner is alleged to have assaulted the informant with knife on his head and other accused persons are alleged to have assaulted with Lathi, but no injury is said to have caused by knife. The injury is caused by hard and blunt object.
Considering the fact that although the petitioner is

No.12290 of 2016 (3) dt.24-06-2016 2/2 alleged to have assaulted with knife but no injury is said to have caused by knife and the doctor opined that the injury caused by hard and blunt object and similarly situated accused have already been enlarged on bail, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kahalgaon P.S. Case No. 299 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
