The petitioner is apprehending his arrest in connection with Barahara P.S.Case No.67/19 registered for offences punishable under Section 392 of the Indian Penal Code. Prosecution story is that while the informant was going, he was intercepted by three miscreants by motorcycle and the collection of Rs.81,783/- was snatched from him, as well as Tab, Mobile and other articles. It further appears that nobody is named in the FIR but the name of the petitioner transpired on the confession of the co-accused, who has been later on arrested. Submission of the learned counsel for the petitioner is that except confession, there is nothing against him and he has no criminal antecedent.

Patna High Court CR. MISC. No.51585 of 2019(2) dt.19-08-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail stating that the investigation is still going on and he has been named in the confessions statement..

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.

With the aforesaid direction, this application is dismissed.
