JUSTICE SANJAY PRIYA ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jamalpur P.S. Case No. 126 of 2016 instituted for the offence under Sections-25(ib)a/26(i)(ii)/35 of the Arms Act. There is allegation that 100 live cartridges have been recovered from possession of the petitioner.
The report has been called for from the court below from which, it appears that charge sheet has already been submitted but trial has not commenced.
It has been submitted that another co-accused namely, Md. Naiyar Alam with similar allegation has already been granted privilege of bail by a coordinate bench of this court vide order dated 09-03-2017 passed in Cr. Misc. No. 4629 of 2017.

No.3703 of 2017 (5) dt.11-04-2017 2/2 Considering the above facts and circumstances, this petition for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jamalpur P.S. Case No. 126 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Munger subject to condition that both the bailors should be close relatives of the petitioner.
