====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Madhuban P. S. Case No. 308/2023 in a case registered for the offences punishable under Sections 302, 120(B), 201 of the Indian Penal Code.
3. As per the prosecution case, co-accused Chhabela Rai and Bhulan Rai took the nephew of informant with them to participate in function but later on, informant came to know that his nephew was murdered. Informant suspects that F.I.R. named accused persons killed his nephew with a view to grab his property.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired
Patna High Court CR. MISC. No.55807 of 2025(3) dt.03-11-2025 2/2 during course of investigation in confessional statement of coaccused Chhabela Rai, who has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 29.02.2024 passed in Cr. Misc. No. 66953 of 2023. Petitioner is in custody since 22.03.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Madhuban P. S. Case No. 308/2023.
