JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner, who is in custody since 28.05.2019, seeks bail in connection with R.P.F. Post Mokama Case No. 01 of 2019, instituted for the offences under Section 3 of the RP (UP) Act.

It has been submitted on behalf of the petitioner that the F.I.R. has been registered against unknown and there is no eye-witness to the occurrence. The petitioner has been made accused in this case only on the basis of the

Patna High Court CR. MISC. No.50619 of 2019(4) dt.16-11-2019 2/2 suspicion.

One of the co-accused persons having similar allegation has been granted bail by a Bench of this Court vide order dated 29.04.2019 passed in Cr. Misc. No. 28076 of 2019.

Considering the aforestated facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Patna in connection with R.P.F. Post Mokama Case No. 01 of 2019.

The application stands allowed.
