JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 412, 395 of the Indian Penal Code and Sections 25(1-B)A, 26 of the Arms Act. Petitioner is said to be caught along with two coaccused persons just after the alleged occurrence and according to seizure list, country made pistol was recovered from possession of the petitioner whereas looted money was recovered from possession of co-accused, Pankaj Kumar Singh @ Pankaj Kumar, who has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 24.11.2016 passed in Cr. Misc. No. 41130 of 2016.

No.7267 of 2017 (2) dt.15-03-2017 2/2 Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent and is languishing in jail custody for more than one year, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case No. 33 of 2016.
