JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

Prosecution case is that the Block Supply Officer, Simari, Bakhtiyarpur intercepted four trucks each loaded with 31 quintals of wheat in 62 bags, when 98 bags of wheat were recovered from near the house and go-down of co-accused Prem Kumar Bhagat.

It is submitted by learned counsel for the petitioner that on mere suspicion the accusation has been levelled. One Aman Kumar Singh, who clamed to have purchased the wheat from the agriculturist and has filed an application for release of the same. Considering the aforesaid facts, let the above named

No.15165 of 2016 (2) dt.12-04-2016 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Saharsa in connection with Bakhtiyarpur P.S. Case No.493/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
