JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-04-2018 Heard the learned counsel for the petitioner and the learned counsel appearing on behalf the Staten as well as the learned counsel for the informant.

The petitioners are apprehending arrest in connection with Pandaul P.S. Case No. 24 of 2017 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code. The learned counsel for the petitioners with reference to the order passed by this Court in the case of Sahina Khatoon @ Manturi Khatoon, Guriya Khatoon, Manzoor Nadaf and Md. Jahangir @ Jahangir Nadaf submits that the case of the petitioners deserves similar treatment like the co-accused. Learned counsel appearing on behalf of the informant vehemently opposed the prayer of bail. However, he is not able

No.25172 of 2018(2) dt.25-04-2018 2/2 to dispute the fact that similarly circumstance co-accused have been granted anticipatory bail vide order dated 06.04.2018 passed in Criminal Miscellaneous No. 18999 of 2018 and vide order dated 19.09.2017 passed in Criminal Miscellaneous No. 40491 of 2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Pandaul P.S.
