JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and the learned Addl. Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Bakhtiyarpur P.S.Case No. 484/2015, disclosing offences under sections 420, 467, 468, 471, 120B of the Indian Penal Code. The petitioner runs a business of photo copying and providing other IT services. It is alleged that one Md. Habib Ansari had made an online application for issuance of income certificate, whereupon an income certificate was issued in his favour, which was found to be forged and signed by a person not authorized to sign it. The online application was made from the centre run by the petitioner. The said Md. Habib Ansari disclosed that the certificate was given by the petitioner. It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.19189 of 2016 (2) dt.13-05-2016 petitioner has falsely been implicated in the present case because he is socially active. It has been submitted that such certificate cannot be issued without connivance of IT Assistant of the concerned block. He has further submitted that there is no likelihood of the petitioner fleeing from the course of investigation, if he is granted privilege of anticipatory bail. Considering the facts and circumstances, this application is allowed.

Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.Singh, Judicial Magistrate, Saharsa in Bakhtiyarpur P.S.Case No. 484/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C. This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
