JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-05-2022 Learned counsel for the petitioners submits that during pendency of this petition, petitioner no. 1 namely Md. Kudus @ Md. Kuddus has already been arrested and as such, this petition has become infructuous, so far as petitioner no. 1 is concerned.

In view of aforesaid fact, the anticipatory bail petition stands dismissed as withdrawn so far as petitioner no. 1 is concerned.

The petitioner no. 2 and 3 apprehend their arrest in a case registered for the offence under Section 341, 323, 324, 325, 307, 379, 504, 34 of the Indian Penal Code. As per the prosecution case, specific allegation of

Patna High Court CR. MISC. No.65784 of 2021(2) dt.24-05-2022 2/2 assault is against other accused persons. Petitioner no. 2 and 3 have been made accused due to land dispute. Injuries are simple in nature. Both petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner no. 2 and 3, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned C.J.M., Araria in connection with Araria (R.S.) P.S. Case No. 311 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Ranjeet/- U T
