2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Amendment Act 2022 .

3 . Prosecution case is that 34 liters of illicit liquor was recovered from Mango Orchard.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The name of petitioner was disclosed by local people . Recovery is from open place . Petitioner is not the owner of mango orchard. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got 1 criminal antecedent of similar nature in which he is on bail.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Court Excise Madhubani in connection with Arer P.S. case No. 109 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the BNSS 2023 .
