The petitioner seeks bail in Rail Sonepur P.S. Case No. 84/2016, registered for the offences punishable under Section 379 of the Indian Penal Code. Later on, section 411 of the Indian Penal Code was added.

It is alleged that bag containing different articles and mobile was stolen by unknown persons.

During the course of investigation, the petitioner and other accused persons were apprehended and from the possession of the petitioner the stolen mobile was recovered. It is submitted that the petitioner has got no criminal antecedent as mentioned in para 3 of the bail petition and the petitioner did not commit any theft. The petitioner is in jail since 02.12.2016.
