JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2018 The petitioners seek bail in anticipation of their arrest in connection with Paharpur P.S. Case No. 324 of 2017, dated 12.11.2017, instituted for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 354, 379, 504 and 506 of the Indian Penal Code. The petitioners are alleged to have entered in the house of the informant and assaulted him and others and are also alleged to have taken away their personal belongings.

Patna High Court Cr.Misc. No.25192 of 2018 (3) dt.03-05-2018 2/2 Learned counsel for the petitioners has submitted that the falsity of the allegation would appear from the fact that the case has been lodged after about one and half months of the occurrence without there being any reason for such delay.

The petitioners are agnates of the informant and the injuries suffered by the victims are all simple in nature. The petitioners do not have any criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. Case No. 324 of 2017.
