Heard learned counsel for the petitioners and the State.
The petitioner seeks bail in Town P.S. Case No. 477 of 2021, registered for the offence under Sections 401, 414/34 of the Indian Penal Code.
As per the prosecution case, these petitioners were apprehended while committing theft. No incriminating article has been recovered from the possession of this petitioner and some key was recovered from the possession of petitioner No.2. It is submitted on behalf of petitioners that no
Patna High Court CR. MISC. No.65323 of 2021(4) dt.25-04-2022 2/2 incriminating article has been recovered from the possession of the petitioners and they have been made accused only on suspicion. Petitioners are in custody since 30.06.2021. Investigation is complete.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Town P.S. Case No. 477 of 2021.
